Acceptance of Terms

By accessing or using IndigoVia's services, website, or any applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms apply to all visitors, users, and others who access or use the Services. We may update these Terms from time to time. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

Eligibility

• You must be at least 18 years of age to use our Services.
• You must be a resident of a state where IndigoVia is licensed to provide services.
• You must provide accurate, current, and complete information during the registration and consultation process.
• You are responsible for maintaining the confidentiality of your account credentials.

Medical Services

Nature of Services

IndigoVia provides hormone therapy, IV therapy, and related wellness services. Our services are provided by licensed healthcare professionals and are intended to complement, not replace, your relationship with your primary care physician.

No Guarantee of Results

Individual results may vary. We do not guarantee specific outcomes from our treatments. The effectiveness of treatments depends on various factors including individual health conditions, adherence to treatment protocols, and lifestyle factors.

Medical Consultations

All medical treatments require a consultation with our healthcare providers. Treatment plans are customized based on individual health assessments and may be modified as needed.

Appointments and Cancellations

• Appointments must be scheduled in advance through our booking system.
• We request at least 24 hours notice for appointment cancellations or rescheduling.
• Repeated no-shows or late cancellations may result in cancellation fees or restrictions on future bookings.
• We reserve the right to cancel or reschedule appointments due to unforeseen circumstances.

Payment Terms

• Payment is due at the time of service unless other arrangements have been made.
• We accept major credit cards and other payment methods as specified on our website.
• Prices for services are subject to change without notice.
• IndigoVia does not bill insurance directly. You may submit claims to your insurance company for potential reimbursement.
• Refunds are handled on a case-by-case basis in accordance with our refund policy.

User Responsibilities

You agree to:

• Provide accurate and complete health information during consultations.
• Follow treatment protocols and instructions provided by our healthcare professionals.
• Report any adverse reactions or concerns promptly.
• Not share prescription medications with others.
• Notify us of any changes in your health status or medications.
• Use the Services only for lawful purposes.

Prohibited Uses

You may not:

• Use the Services for any illegal or unauthorized purpose.
• Attempt to obtain medications for non-medical or performance-enhancing purposes.
• Provide false or misleading information.
• Interfere with or disrupt the Services or servers.
• Attempt to gain unauthorized access to any portion of the Services.
• Use the Services to transmit harmful or malicious content.

Intellectual Property

All content, trademarks, logos, and intellectual property displayed on our website and Services are the property of IndigoVia or our licensors. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

Limitation of Liability

To the maximum extent permitted by law, IndigoVia and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability for any claims arising from the use of our Services shall not exceed the amount you paid for the specific service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless IndigoVia, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another party.

Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Jacksonville, Florida.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Termination

We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Text Message Program (SMS)

Program: IndigoVia Appointment Messages. If you choose "Yes" to text messages when you book on indigovia.com and give us your mobile number, you agree to receive text messages from IndigoVia that (a) confirm your appointment, (b) remind you of your appointment, and (c) tell you what to complete before your visit, such as consent and health history forms and downloading our telehealth app.

Agreeing to receive these texts is your choice and is not a condition of booking or of receiving care. If you choose "No", your booking is the same and we send your appointment details by email. For telehealth visits, our care team may still text you a link to download our telehealth app.

Message frequency varies with your appointments. A typical booking sends a confirmation, one or more reminders, and, for telehealth visits, a link to download our app. Message and data rates may apply.

To stop receiving texts, reply STOP at any time. You will receive one message confirming you are unsubscribed. We will still contact you by email and phone about your appointment. For help, reply HELP, call 904-339-8204, or email admin@indigovia.com.

Carriers are not liable for delayed or undelivered messages. We do not share your mobile information with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
